Controller: a natural or legal person, under public or private law, who is responsible for decisions regarding the processing of personal data;
Processor: a natural or legal person, under public or private law, who processes personal data on behalf of the Controller;
Processing: any operation carried out with personal data, such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination or extraction;
Personal Data: information relating to an identified or identifiable natural person;
Sensitive Personal Data: personal data concerning racial or ethnic origin, religious belief, political opinion, membership of a trade union or organization of a religious, philosophical or political nature, data concerning health or sexual life, genetic or biometric data, when linked to a natural person;
Data Subject: the natural person to whom the personal data being processed refers, such as employees, legal representatives and agents of clients, potential clients and/or partner companies.
LGPD – General Data Protection Law: Law No. 13,709/2018, which regulates the processing of Personal Data carried out in Brazilian territory or aimed at offering goods or services to individuals located in Brazil, or where the data subject to processing was collected in Brazilian territory, regardless of where the data is located.
Partner: companies with whom BACKLGRS has contractual relationships for the purpose of developing commercial activities.
Service Provider(s): natural or legal persons who provide services contracted by Backlgrs.
Privacy by Default: a concept derived from Privacy by Design. It establishes that a product or service, when launched on the market, must have all restricted privacy settings as determined during its development, and only the user can enable or disable access if necessary.
Privacy by Design: a premise for the development of services or products that requires the application of good privacy practices from the outset. Thus, any new processing activity must comply with the principles, rules and standards provided and determined by applicable legislation throughout its entire life cycle.
International Data Transfer: the transfer of personal data carried out by a processing agent located in Brazil to a foreign country or an international organization of which Brazil is a member.
DATA PROTECTION PRINCIPLES
Backlgrs processes personal data in accordance with the principles established by the General Personal Data Protection Law (LGPD), with particular regard to:
- Purpose: processing of personal data for legitimate, specific, explicit, and informed purposes;
- Adequacy: compatibility of the processing with the purposes disclosed to the data subject;
- Necessity: limitation of processing to the minimum personal data necessary to fulfill its purposes;
- Free Access: guarantee to data subjects of easy and free access to information about the form and duration of processing;
- Data Quality: guarantee of accuracy, clarity, relevance, and currency of personal data;
- Transparency: provision of clear, accurate, and easily accessible information about personal data processing;
- Security: use of technical and administrative measures to protect personal data from unauthorized access and accidental or unlawful situations;
- Prevention: adoption of measures to prevent harm arising from personal data processing;
- Non-Discrimination: prohibition of processing for unlawful or abusive discriminatory purposes;
- Accountability: demonstration of the adoption of effective measures capable of proving compliance with personal data protection standards.
PROCESSING AGENTS
With regard to personal data collected through the “Contact” form mentioned above, Backlgrs acts as the Data Controller, within the terms and limits set out in this Policy.
QUALIFICATION OF PERSONAL DATA PROCESSED AND PURPOSES
Backlgrs processes personal data of individuals who complete the “Contact” form available in the “Contact” section of the website. Data subjects may include legal representatives and/or agents of clients and suppliers, as well as potential clients/suppliers. The data collected through the “Contact” form on this website is limited to:
- Name;
- Company name represented;
- Corporate email;
- Corporate phone number;
- Text box for describing the reason for contact.
Backlgrs respects the principle of necessity set out in the LGPD, as these data represent the minimum necessary to fulfill the purpose of contacting the individual to provide the expected response or service.
Therefore, the sole purpose of processing the collected data is to respond to the initial contact made by the person, fulfilling or seeking to fulfill their expectations in relation to Backlgrs.
Backlgrs’ products and services are not intended for children or adolescents. Therefore, Backlgrs does not process personal data of children or adolescents for the purposes set out in this Policy.
6. APPLICABLE LEGAL BASES
Backlgrs processes personal data as described above on the basis of legitimate interest, given that the data subject voluntarily initiated contact with the company.
If the data subject expresses interest in contracting Backlgrs’ services, the processing may also be based on the execution of preliminary procedures related to a contract or the performance of a contract, pursuant to the LGPD.
Backlgrs processes personal data exclusively for determined and legitimate purposes, ensuring that data subjects are duly informed about such purposes and the processing activities carried out.
7. SHARING OF PERSONAL DATA
Backlgrs has partner companies that offer complementary services. When necessary to meet the data subject’s needs, Backlgrs may share contact details and the stated needs with relevant partner companies, so they can assess the possibility of fulfilling the request presented by the data subject.
Sharing always occurs in compliance with the purposes set out in this Policy and with high standards of confidentiality, security, and data protection, in accordance with applicable regulations. Sharing may occur:
- With strategic partners and suppliers directly involved in the execution of Backlgrs’ activities, subject to contractual confidentiality and data protection clauses;
- With public authorities or regulatory bodies, upon legal request or compliance with a regulatory obligation.
Backlgrs’ strategic partner companies may be:
- Companies that own technology products or platforms, such as software or digital solutions, when Backlgrs identifies that the data subject seeks or requires solutions offered by such companies;
- Companies providing specialized services or consulting, when Backlgrs determines that the data subject’s needs may be better met by a partner with specific expertise.
Backlgrs reaffirms its commitment to not selling or improperly sharing personal data.
8. INTERNATIONAL DATA TRANSFER
The only circumstance in which an international transfer of data collected by this website may occur is when the data subject requires a service provided by a partner company that also operates in Portugal. However, the legislation applicable in Portugal follows the standards established by the GDPR (General Data Protection Regulation), which provides a high level of personal data protection and principles compatible with the LGPD. Therefore, even if this situation arises, it is covered by applicable law as it maintains the same security standards.
Furthermore, Backlgrs only permits transfers to companies that ensure levels of protection compatible with Brazilian legislation and through the adoption of appropriate safeguards, such as specific contractual clauses for security and personal data protection.
9. STORAGE OF PERSONAL DATA
Personal data processed by Backlgrs will be stored only for the period necessary to fulfill the purposes set out in this Policy. In the case of a contract, for the period necessary to perform the contract, as well as to meet legal and/or regulatory obligations, and may also be retained when necessary for risk management or for the regular exercise of rights in judicial, administrative, or arbitration proceedings.
After the purpose has been fulfilled, and unless the security exceptions listed above apply, the data will be automatically deleted.
10. PERSONAL DATA SECURITY
Information security and personal data protection are priorities for Backlgrs. To this end, a set of technical and organizational measures is adopted to prevent, detect, respond to incidents and mitigate risks, including cybersecurity risks.
Backlgrs applies security and confidentiality standards aligned with market best practices, including but not limited to those aligned with international information security best practices and frameworks. In addition, specific tools and technologies are used to protect the integrity and confidentiality of information, restricting access to data only to authorized individuals, subject to strict confidentiality obligations and operational traceability, encryption, and periodic training on data protection and information security.
11. DATA SUBJECT RIGHTS
The LGPD grants data subjects various rights, which may be exercised at any time with Backlgrs. These include:
- Confirmation of the existence of processing and access to personal data;
- Correction or updating of incomplete, inaccurate, or outdated data;
- Anonymization, blocking, or deletion of unnecessary, excessive, or non-compliant data;
- Data portability, subject to applicable regulations;
- Information on the possibility of withholding consent and the consequences of doing so;
- Revocation of consent or objection to processing, subject to legal grounds for maintaining processing;
- Request for review of automated decisions that affect the data subject;
- Cancellation of marketing communications or targeted offers;
- Information on public and private entities with which Backlgrs has shared data.
